Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the Cynternet platform (the “Platform”), operated by Cynternet (“we,” “us,” or “our”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Definitions

  • “Platform” refers to the Cynternet website, application, and all related services.
  • “User” refers to any individual or entity that accesses or uses the Platform, including Job Seekers, Recruiters, and Administrators.
  • “Job Seeker” refers to a User who creates an account to search for and apply to job opportunities.
  • “Recruiter” or “Employer” refers to a User who posts job listings and manages recruitment activities.
  • “Content” refers to all text, images, data, files, and other materials uploaded to or displayed on the Platform.

2. Eligibility

  • You must be at least 18 years of age to create an account and use the Platform.
  • By creating an account, you represent that you have the legal capacity to enter into a binding agreement.
  • If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration & Security

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must notify us immediately of any unauthorized access to or use of your account.
  • We reserve the right to suspend or disable accounts that contain inaccurate or fraudulent information.
  • One person or entity may not maintain multiple accounts without prior written permission.

4. Job Seeker Terms

  • You agree to provide truthful, accurate information in your profile, resume, and job applications.
  • You may not misrepresent your qualifications, experience, skills, or employment history.
  • You may not submit applications using false identities or on behalf of another person without their consent.
  • We do not guarantee employment through the use of our Platform. Cynternet acts as an intermediary connecting Job Seekers with Employers and is not a party to any employment agreement.
  • You are solely responsible for evaluating the suitability of any job opportunity and for the terms of any employment you accept.

5. Recruiter & Employer Terms

  • Job postings must be for genuine, lawful employment opportunities. Fraudulent, misleading, or fictitious job postings are strictly prohibited.
  • You may not post job listings that discriminate based on race, gender, religion, age, disability, sexual orientation, national origin, or any other protected characteristic.
  • You are responsible for the accuracy and legality of all job posting content, including compensation details and job requirements.
  • You may not use candidate information obtained through the Platform for any purpose other than evaluating candidates for the posted position.
  • You must comply with all applicable employment and labor laws in your jurisdiction.
  • Cynternet does not verify the legitimacy of every employer or job posting. However, we reserve the right to remove any posting that violates these Terms.

6. Prohibited Conduct

All Users agree not to:

  • Use the Platform for any unlawful, fraudulent, or malicious purpose.
  • Scrape, crawl, harvest, or collect data from the Platform using automated tools without our express written consent.
  • Impersonate another person, entity, or Cynternet representative.
  • Upload, transmit, or distribute viruses, malware, trojans, or any other harmful code.
  • Send spam, unsolicited messages, or bulk communications to other Users.
  • Attempt to gain unauthorized access to other User accounts, Platform systems, or databases.
  • Interfere with or disrupt the Platform’s infrastructure, servers, or networks.
  • Post defamatory, obscene, harassing, threatening, or otherwise objectionable content.
  • Use the Platform to collect personal information of other Users for purposes unrelated to recruitment.
  • Circumvent, disable, or interfere with any security features of the Platform.
  • Resell, sublicense, or commercially exploit Platform access without our written consent.

7. Content & Intellectual Property

7.1 Our Content

All Platform design, code, logos, trademarks, graphics, text, and other intellectual property are owned by Cynternet or its licensors and are protected by applicable intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from our content without explicit written permission.

7.2 Your Content

You retain ownership of content you upload (resumes, profile information, job postings, etc.). By uploading content, you grant Cynternet a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Platform.

You represent that you have the right to upload all content you submit and that it does not infringe on any third party’s intellectual property or other rights.

7.3 DMCA & Copyright Complaints

If you believe that content on the Platform infringes your copyright, please contact us with a detailed notice including identification of the copyrighted work, the infringing material, and your contact information.

8. Fees & Payments

  • Certain features of the Platform may require payment. Applicable fees will be clearly displayed before purchase.
  • All payments are non-refundable unless otherwise stated or required by applicable law.
  • We reserve the right to change pricing with prior notice to affected Users.

9. Third-Party Links & Services

The Platform may contain links to third-party websites or integrate with third-party services. We do not control or endorse these third parties and are not responsible for their content, privacy policies, or practices. Your interactions with third-party services are governed by their own terms.

10. Disclaimers

  • The Platform is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.
  • We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  • We do not verify or endorse the qualifications of Job Seekers, the legitimacy of Employers, or the accuracy of job postings.
  • We are not responsible for any employment decisions, workplace conditions, or disputes arising from connections made through the Platform.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Cynternet shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
  • Our total liability for any claim arising from these Terms or the Platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or INR 10,000, whichever is greater.
  • This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).

12. Indemnification

You agree to indemnify, defend, and hold harmless Cynternet, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform.
  • Your violation of these Terms.
  • Your violation of any third-party rights.
  • Any content you upload or submit to the Platform.

13. Termination

  • You may deactivate your account at any time through your account settings.
  • We may suspend or terminate your account at our sole discretion, with or without notice, for violation of these Terms or for any other reason we deem necessary.
  • Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect.
  • We may retain certain data after account termination as described in our Privacy Policy and Data Retention Policy.

14. Dispute Resolution

  • These Terms are governed by and construed in accordance with the laws of India.
  • Any disputes arising from these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation.
  • If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in India.
  • Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. When material changes are made:

  • We will update the “Effective Date” at the top of this page.
  • We will notify registered Users via email.
  • Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

If you disagree with any changes, you must stop using the Platform and deactivate your account.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Data Retention Policy, constitute the entire agreement between you and Cynternet regarding your use of the Platform.
